Terms of service.

These terms govern access to and use of the Saaro Health platform by a clinic and its authorised staff. By creating an account, you agree to these terms.

1. The agreement

These terms form a contract between Lumotis Digital Media, a company based in Jaipur, Rajasthan, India ('Lumotis', 'we', 'us'), and the clinic entity that registers for a Saaro Health account ('clinic', 'you'), governed by the Indian Contract Act, 1872 and applicable Indian law.

2. The service

Saaro Health is a clinic management platform providing patient record-keeping, voice-assisted prescriptions, appointment scheduling, GST-compliant billing, WhatsApp-based patient messaging via SaroConnect, and ABDM/ABHA-related functionality, as described on our product pages.

3. Accounts and eligibility

You must be a licensed healthcare practice or an authorised representative of one to register a clinic account. You are responsible for the accuracy of information provided at signup and for maintaining the confidentiality of staff login credentials.

4. Plans and billing

  • Current published pricing is available on our pricing page and is billed annually unless otherwise agreed in writing.
  • Prices exclude GST, which is charged in addition at the applicable rate.
  • Patient messaging via SaroConnect is included in every plan and is not billed separately per message.
  • Fees are non-refundable except as required by law or as separately agreed.
  • We may change pricing for future billing cycles with reasonable prior notice to your account's registered contact.

5. Your responsibilities

As the clinic, you are responsible for: obtaining valid patient consent for data collection and processing; the clinical accuracy of information entered into the platform, including AI-assisted drafts, which must be reviewed by a qualified practitioner before being finalised; compliance with applicable healthcare, telemedicine and prescribing regulations; and maintaining accurate staff access permissions.

6. Data ownership and processing

You retain ownership of the patient and clinic data you enter into Saaro Health. We process that data as a service provider on your instructions, as described in our Privacy Policy and Data Processing Agreement, and do not use patient health data for purposes other than providing and improving the service, except as required by law.

7. Acceptable use

You agree not to use Saaro Health to: violate applicable law, including healthcare advertising and telemedicine regulations; send unsolicited or non-consented messages to patients; attempt to access another clinic's data; or reverse-engineer or resell the platform without our written consent.

8. Service availability

We aim to meet the availability targets described on our uptime and SLA page. Planned maintenance is communicated in advance where practicable. We are not liable for outages caused by factors outside our reasonable control, including internet service provider failures or force majeure events.

9. Limitation of liability

To the maximum extent permitted by law, Lumotis's aggregate liability arising from your use of Saaro Health is limited to the fees paid by your clinic in the twelve months preceding the claim. Nothing in these terms limits liability that cannot be limited under applicable Indian law, including in respect of gross negligence or wilful misconduct.

Saaro Health is a record-keeping and workflow tool. Clinical decisions, including AI-assisted drafts of prescriptions or notes, remain the responsibility of the treating practitioner, who must review and approve them before they are acted upon.

10. Termination

Either party may terminate the agreement with notice as set out in your order form or, absent one, thirty days' written notice. On termination, we will make your data available for export for a reasonable period, after which it will be deleted or retained in accordance with our Data Processing Agreement and applicable record-retention law.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated to your account's registered contact with reasonable notice before taking effect.

12. Governing law

These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan.
